What To Do In Case Of An Accident

So you’ve been in an accident, and you’ve wisely begun to consider how best to proceed. What should you do? While in the immediate future you should heed the advice of your doctor, there are definitely good and poorly considered actions you can take to affect your legal situation.

1. Take Care Of Yourself – There is nothing more precious than your good health. While evidence collection should begin sooner rather than later, it will all be for naught if you end up hurting yourself by ignoring your medical condition. Even cuts and scrapes should be checked by a paramedic or doctor before anything else.
2.  Observe – Document everything – everything! Write down the conditions of the accident scene, or better yet, take a lot of pictures. Images will be some of the most important evidence you can have to prove your case.
   
   Make sure to take images of any injuries you sustained as soon as possible. Injuries heal over time, and a visual is always more compelling than a doctor’s statement.
   
   Take note of who observed the accident, if possible. Get their names, contact information, and write down / record their perception of events if they’re willing. Unbiased witnesses are a HUGE help in court.
    
3. Remain Quiet – The phrase “anything you say can and will be used against you in court” isn’t just for TV detectives. You may receive phone calls from insurance adjusters or others who have an interest in the outcome of your potential lawsuit. If you don’t know them, don’t talk to them. Make it clear to your family that the issue doesn’t get discussed outside the home, even to neighbors.
